According to Title 42, U.S.C., Section 1981 (n.d.), also known as the Equal Rights under the Law statute, all individuals within the jurisdiction of the United States are granted the same rights in every State and Territory to engage in various legal actions (Title 42, U.S.C., Section 1981, n.d.). These actions include making and enforcing contracts, participating in legal proceedings, providing evidence, and enjoying the full protection of all laws and legal processes that ensure the safety of individuals and their property (Title 42, U.S.C., Section 1981, n.d.). This entitlement is extended to all persons without any discrimination, providing them with rights equivalent to those enjoyed by white citizens. Additionally, these individuals are subject to comparable penalties, taxes, licenses, and requirements as white citizens, and no other distinctions are imposed upon them.

In subsection (b) of this statute, the term “make and enforce contracts” is defined broadly. It encompasses not only the creation and execution of contracts but also their performance, modification, and termination. Furthermore, this definition encompasses the complete range of benefits, privileges, terms, and conditions associated with the contractual relationship.

Subsection (c) emphasizes that the rights safeguarded by this statute are protected against impairment due to both private discrimination and impairment under the pretext of State law (Title 42, U.S.C., Section 1981, n.d.).
