China’s Updated Law on the Protection of Rights and Interests of Women Takes Effect on January 1, 2023

As of January 1, 2023, China’s updated Law on the Protection of Rights and Interests of Women has come into effect, aimed at promoting gender equality, eliminating discrimination against women in all forms, and preventing the exclusion or restriction of their legitimate rights and interests (Xinhua News Agency, 2023). This updated law represents an important step forward in the protection of women’s rights and interests in China.

Under the new law, all levels of government and relevant departments are required to optimize employment security measures for women, prevent and redress gender discrimination, and create a fair employment and entrepreneurial environment (Xinhua News Agency, 2023). This includes the inclusion of gender discrimination in job recruitment, admission, promotion, and dismissal in labor rights protection supervision. By doing so, this updated law aims to ensure that women have equal access to employment opportunities and are not discriminated against in the workplace based on their gender.

The new law also mandates the implementation of a maternity insurance system, establishment and improvement of security systems related to maternity, including childcare services for infants and young children, and optimization of the maternity leave system (Xinhua News Agency, 2023). This is an important step towards promoting the health and wellbeing of women and their children in China. By providing maternity insurance and improving childcare services, this law aims to support women in balancing their work and family responsibilities and help to reduce the burden of childcare.
